Terms of Service

1. Acceptance of Terms

By accessing or using CARB Compliance Service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including fleet operators, administrators, and any other persons who access the Service.

2. Description of Service

CARB Compliance Service provides California fleet operators with tools to monitor, track, and manage compliance with the California Air Resources Board (CARB) Clean Truck Check (CTC) program. The Service includes a compliance dashboard, vehicle test due date tracking, deadline alerts, portal data synchronization, and related features as described on our website.

The Service is not affiliated with, endorsed by, or operated by the California Air Resources Board. We are an independent third-party service provider.

3. Subscription Plans and Billing

The Service is offered on a subscription basis. By enrolling in a paid plan, you authorize American Trans Data Systems to charge your payment method on a recurring monthly basis at the rate applicable to your selected plan tier.

• Free Trial: Self-Service and Full-Service Small Fleet plans include a 30-day free trial. Your payment method is verified at signup but not charged until the trial period ends. You may cancel at any time before the trial ends to avoid any charge.
• Cancellation: You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days.
• Price Changes: We reserve the right to change subscription pricing with 30 days' advance notice via email to the address on your account.
• IRP Customers: Fleet operators registered with American Trans Data Systems under the International Registration Plan (IRP) receive complimentary access to the Service at no additional charge, subject to maintaining an active IRP account in good standing.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect unauthorized access to your account.

You agree to provide accurate and complete information when creating your account and to keep that information current. Accounts created with false information may be terminated without notice.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Attempt to gain unauthorized access to any portion of the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated means to access the Service in a manner that exceeds reasonable usage
• Resell or sublicense access to the Service without prior written consent

6. Data and Privacy

We collect and process fleet compliance data, vehicle information, and account data as necessary to provide the Service. We do not sell your personal information to third parties. Your data is stored securely and used solely to deliver the Service and communicate with you about your account.

By using the Service, you grant American Trans Data Systems a limited license to access, process, and store your fleet data for the purpose of providing the Service. You retain ownership of your data at all times.

For CARB portal synchronization features, you may provide CARB portal credentials. These credentials are used solely for the purpose of syncing your compliance data and are not stored permanently on our servers.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. AMERICAN TRANS DATA SYSTEMS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

CARB Compliance Service is an informational and management tool. It does not guarantee regulatory compliance. You remain solely responsible for ensuring your fleet meets all applicable CARB requirements. We strongly recommend verifying compliance status directly with the California Air Resources Board.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMERICAN TRANS DATA SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless American Trans Data Systems, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or your violation of these Terms.

10. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time with or without notice. We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and notify active subscribers by email. Continued use of the Service after changes constitutes acceptance of the revised Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.
